1. Introduction

These terms and conditions govern your relationship with Dulcinea’s Retreat (also referred to as “The Retreat”, “ “El Retiro de Dulcinea”, “El Retiro”, “Dulcinea”, “we”, “us”, “our”) and all bookings you make with us. Please read these Terms and Conditions carefully, as they affect your rights and responsibilities under the law.

We operate this website in order to promote our sustainable accommodation, and to sell the products and services provided by us. By using this site, you signify and confirm your acceptance of these terms and conditions (T&Cs). We reserve the right to revise and modify these terms and conditions from time to time. We therefore recommend that you continue to review these T&Cs when you access or use this site. If you do not agree to these Terms and Conditions, please do not make your booking through this website. You can also book through www.booking.com, www.airbnb.com, www.clubrural.com, www.bedanbreakfast.eu, www.homeexchange.com, www.hotelandplace.com, and other platforms, where you must accept their particular T&Cs.

2. Booking and Registration

2.1. To make a reservation through El Retiro de Dulcinea, you do not need to register with us.

2.2. You must be at least 18 years of age to make a booking with us.

2.3. You must ensure that the personal details provided when making a booking, and at any time thereafter, are correct and complete.

2.4. You must inform us as soon as possible of any changes to the information you provided when making your booking by updating your personal details immediately.

2.5. The data you provide to us is governed by our privacy policy, which is available here.

2.6. You will receive an email notification confirming your booking, please save this email with your booking information.

2.7. It is your responsibility to obtain and cover the cost of the necessary tools and services (computer, telephone, Internet connection, etc.) to access this website, make the booking and pay for it.

3. Payments

3.1. Either to make payment or to guarantee your booking and deposit, you must provide El Retiro de Dulcinea with the details of a valid credit or debit card (with the MasterCard or Visa symbol). You must inform us as soon as possible of any changes to your card details at least 48 hours before the start of your stay by calling us on 684036865 or by emailing us.

3.2. You can still pay by bank transfer and send us the receipt, regardless of whether you have provided us with a valid credit or debit card for the deposit or other services in addition to your booking.

3.3. We make every effort to ensure the security of your data. We use the payment information provided when you register to enable us to charge for services, activities or products in addition to your booking.

3.4. Once we have confirmed that the activities or products you have ordered are available during your stay, your card will be charged accordingly.

3.5. We accept no responsibility for the time it may take for the relevant banks to process your payments.

3.6. We reserve the right to refuse the request for activities, services or products, if you have stopped or suspended payments through the card you have provided us with. Through these T&Cs you agree to compensate us in full for all reasonable costs and expenses (including legal costs) incurred in order to obtain payments that have not been made in accordance with these terms and conditions.

3.7. If your bank has declined payment, you must contact us as soon as possible to arrange payment and wait for payment to be made before you can make changes to your booking via our website again. However, you can change your activities, products or packages by calling us or sending us an email, during the opening hours of our office and subject to the minimum notice period of 48 hours before the start of the stay.

4. Orders and shopping at biofood.es

4.1. If you place an order or make a purchase on our sister project, www.biofood.es, our ecommerce’s Terms and Conditions will apply to your purchase in general, and Section 5 of those T&Cs in particular.

5. Cancellation rights

5.1. You may cancel your booking with us at any time by emailing or calling us, subject to the minimum cancellation period and notice requirements set out on our site. Suspending or cancelling your booking will not affect or remove any rights or obligations accrued up to that point. Any purchases made and already prepared (according to 5.15 T&C Biofood.es) prior to the cancellation of your booking will remain binding.

5.2. El Retiro may cancel or suspend your booking(s) even if already accepted, at our reasonable discretion, or if you are in breach of any of your obligations under thes Terms and Conditions.

6. Warranties, Liabilities and Applicable Law

6.1. Dulcinea’s Retreat attempts to ensure that the material on our Website or any other booking platform, catalogue, brochure, poster or other, is accurate and up to date at all times. However, we cannot be held responsible if, despite our best efforts, this is not the case. Without prejudice to your statutory rights, El Retiro may correct any inaccuracies and/or errors and shall only be liable for merely correcting or updating the inaccuracy and /or error, and in no event for any results arising from the use of such information or for any technical problems that the website may experience.

6.2. We guarantee that our Services and Products will be of satisfactory quality and condition (with the exception of defects caused by your misuse, negligence or by accidents during your stay). Please notify us if you are dissatisfied with any of our Services and Products.

6.3. We accept no responsibility or liability in relation to any representation that El Retiro de Dulcineamay make of any external brand.

6.4. Our total liability under these terms and conditions shall not exceed the purchase price of the Services and Products in question.

6.5. We shall not be liable for delay or failure to perform our contractual obligations if due to reasons beyond our reasonable control such as, but not limited to: fire, flood, adverse weather, strikes, labour disputes, riots, civil disturbances, accidents, interruptions to power supplies, equipment or supplier failures, traffic problems, terrorism or war.

6.6. You are strictly prohibited from reassigning, sublicensing or otherwise transferring your reservation rights, services and products under these terms and conditions.

6.7. These terms and conditions are governed by and construed in accordance with Spanish law and Spanish courts in Toledo province shall have exclusive jurisdiction over any dispute arising in connection with these terms and conditions.

6.8. If any provision of these T&Cs is found to be invalid by a court of competent jurisdiction, the invalidity of that provision shall in no way affect the validity of any other provision within these terms and conditions.
